Gentlemen of the Jury, Gentlemen, I'm Doctor Maxwell Toombs Summerlin. My dental offices are in the Southern Mutual Building. We all know each other.
I want to say in the start that I knew absolutely nothing of whatever operation performed at my office on Miss Viola Parr by Dr. Waters.
Miss Parr did not consult or ask permission to use my office, so I don't know anything about any such operation.
Miss Parr had been working for me, I believe, since about the first of June.
I first met Miss Parr when she come to my office with a cousin of hers that was having work done. I forget her name. This cousin had already made two or three visits.
Miss Parr's cousin knew I had lost one girl through moving away from the town.
She asked me if we needed another girl. She said Miss Parr was not working at that time, but she had been working at the telephone exchange.
After I was done working on Miss Parr's cousin, Miss Parr and me, we soon come to terms.
Miss Parr went to work for me the next day and worked continually up until the 20th of February. I believe that was the day they claim she had this operation.
I was not connected with Dr. Waters and knew absolutely nothing of his coming to my office for any operation.
I knew nothing of the condition of Miss Parr being pregnant and I knew nothing of her getting Dr. Waters to come to my office to do this operation.
Furthermore, I didn't have any connection whatever with the case.
